Experience

Mr. Mass is a highly accomplished litigation trial attorney and general counsel with twenty years experience in commercial, construction, insurance, employment, intellectual property, products liability, real estate, securities and general civil litigation matters in State and Federal courts. He has a proven track record in handling jury and bench trials, negotiating complex business transactions, protecting intellectual property, preparing contract documents, formulating effective risk management strategies for businesses and managing outside counsel.

Mr. Mass has represented a variety of business and individual clients in a wide range of civil litigation disputes, including those involving construction defect and injury, wage and hour claims, food borne illnesses, legal and medical malpractice, bad faith, real property, inverse condemnation, premises liability, vehicle accidents, cheerleading injuries, copyright and trade make infringement, and discrimination.

He works closely with his business clients to formulate effective risk management practices and employment policies, including drafting detailed Employee Handbooks that comply with multiple States and Federal law. He also assists clients with business entity formation, contractual dispute resolution, Federal Equal Employment Opportunity Commission (EEOC) and the California Department of Fair Employment & Housing (DFEH) claims, and collection matters. Mr. Mass has prepared and negotiated Prime Construction Contracts and Subcontract Agreements and worked closely with contractors specializing in high-end residential and commercial development projects to enforce Mechanic’s Liens and other remedies.

He has handled numerous construction disputes involving defects, delays and mismanagement for contractors and homeowners. He also has extensive experience in the prosecuting and defending legal malpractice, products liability, premises liability, intellectual property, real estate, and malicious prosecution actions in both State and Federal courts.

Mr. Mass represented a structural engineer in a complex construction defect, products liability and commercial litigation action arising out of the failure of steel moment frame connections in a Santa Monica medical office building as a result of the January 1994 Northridge earthquake. In addition, he received a defense verdict in a racial and gender discrimination action and obtained the dismissal of a bitterly contested copyright infringement action.

Mr. Mass successfully handled the defense of a Beef Supplier in a complex commercial litigation action arising out of the outbreak of food borne illnesses caused by the consumption of hamburger patties containing E. coli 0157:H7 bacteria at Jack-in-the-Box restaurants in the Pacific Northwest. This multi-million dollar action involved complex legal issues of market share and breach of warranty theories of liability. Extensive written discovery and well over one hundred depositions were taken.

Mr. Mass works closely with his clients to evaluate the strengths and weaknesses of each case in order to determine the best approach to handling the litigation. He also analyzes the business practices of his clients with an eye toward avoiding costly and time consuming litigation. However, in the event litigation does occur, he has extensive experience and with the spectrum of alternative dispute resolution proceedings. He has represented clients in AAA and JAMS arbitration proceedings and has served as an arbitrator for the Los Angeles Superior Court and FINRA.

Personal

Mr. Mass was born in Chicago, IL in 1965 and moved to Los Angeles in 1988. He is married to his beautiful wife Martina, a commercial actress and has twin boys, Oliver and Grant. Mr. Mass enjoys the outdoors, food, sports and travel.
